1. Acceptance of Terms

By accessing or using AIARVA ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

AIARVA is an AI-powered search, conversation, task execution, and image generation platform. The Service provides web search with citations, multi-model AI responses, agentic task execution, and AI-generated images through web and mobile applications.

3. Account Registration

• You must be at least 13 years old to use the Service
• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

4. Subscription Plans and Billing

• Free tier: limited daily usage with advertisements; no payment required
• Paid plans (Personal, Pro, Business): billed monthly or annually via Stripe
• Subscriptions auto-renew unless cancelled before the renewal date
• Refunds: you may request a refund within 7 days of initial purchase; no refunds for partial billing periods
• We reserve the right to change pricing with 30 days' notice
• Usage limits are enforced per plan; exceeding limits may result in temporary throttling

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to reverse-engineer, decompile, or extract AI models
• Use automated tools to scrape, crawl, or extract data from the Service at scale
• Interfere with or disrupt the Service or its infrastructure
• Impersonate any person or entity or misrepresent your affiliation
• Use the Service for competitive intelligence gathering against AIARVA
• Circumvent rate limits, usage restrictions, or access controls
• Generate content that infringes intellectual property rights of others

6. Intellectual Property

6.1 Our Content

The Service, including its design, code, logos, and documentation, is owned by AIARVA and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content.

6.2 Your Content

You retain ownership of content you create using the Service (search queries, uploaded files, conversations). You grant us a limited license to process your content as necessary to provide the Service.

6.3 AI-Generated Content

Content generated by AI models through the Service (text responses, images) is provided for your use. You are responsible for reviewing AI-generated content before relying on it. We do not guarantee the accuracy, completeness, or legality of AI-generated content.

7. API Access

Pro and Business plan users may access the AIARVA API subject to rate limits defined by their plan. API keys are confidential; you must not share or expose them in client-side code. We may suspend API access for abuse or excessive usage.

8. Disclaimers

• The Service is provided "as is" without warranties of any kind, express or implied
• AI-generated responses may contain errors, hallucinations, or outdated information — verify important information independently
• We do not guarantee uninterrupted or error-free service availability
• Search results reflect third-party sources; we are not responsible for their accuracy

9. Limitation of Liability

To the maximum extent permitted by law, AIARVA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold AIARVA harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from your settings. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after account deletion, after which it will be permanently removed.

12. Modifications

We may modify these Terms at any time by posting the revised Terms on the Service. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Continued use after modifications constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of New South Wales, Australia. Any disputes arising from these Terms shall be resolved in the courts of New South Wales, Australia.
